Earlier on May 17, Congress-JD (S) alliance moved the plea in the top court asking to set aside the nomination of Anglo-Indian Vinisha Nero by the Governor till newly elected Karnataka Chief Minister BS Yeddyurappa undergoes a floor test in the House to prove his majority. "We will announce the waiver within two days", Yeddyurappa told the media. BJP leader B S Yeddyurappa took oath as chief minister in Bengaluru on Thursday.

The BJP won 104 seats in Karnataka's 224-member legislature, more than any other party but eight short of the majority, according to the Election Commission of India. With the threat of cross-voting or abstention defying the party whip looming large for the Congress-Janata Dal (Secular) alliance, the Speaker's election will play a crucial role in the political play. He also claimed that the Congress MLAs, who had been holed up inside a resort and are now being taken to Kerala, will vote for them (the BJP). The Congress-JDS lawyer also sought proper security for their MLAs in case of floor test being conducted. However, the bench of Justices AK Sikri, SA Bobde and Ashok Bhushan have declared for conducting Floor Test tomorrow considering the urgency in the issue.

India's Prime Minister Narendra Modi has eked out a narrow, uncertain victory following a bitterly-fought state election in the south Indian state of Karnataka, with its minority government sworn in Thursday.

Karnataka Governor Vajubhai Vala had invited BS Yeddyurappa to form the government following which he was sworn in as the state's chief minister. In this case, as Mr Yeddyurappa is yet to undertake the floor test, he does not have the legal, moral or constitutional authority to advise the governor to exercise his power under Article 333. The interim application is likely to be heard on Friday along with the main petition of the combine.

The apex court made it clear that it would deal with the constitutionality of the Governor's letter inviting Yeddyurappa to form the government later.The bench said ultimately the question is about majority which has to be proved in the floor test.

A strong showing by the BJP in Karnataka has given him momentum for a re-election bid in next year's national polls and opened a path for more reforms, analysts say. Any party or grouping needs 112 members to claim majority as per the present strength of the House. He has given room for the BJP to improve its number tally by attempting to break the Congress Party or the JD (S) and the same can not be done without horse-trading, which is an offence.

Lashing out at the Governor's move, the Congress called it "partisan and biased" and rushed to the Supreme Court for an urgent hearing that commenced at 2.20 a.m. and concluded at 5.30 in the morning.
