Avenatti Must End 'Publicity Tour' to Take Part in Michael Cohen's Federal Case, Judge Says
02 June, 2018, 05:15
But he withdrew the request after a court hearing Wednesday in NY in which a judge told him that while he is free to speak out now, he would have to end his "publicity tour on TV and elsewhere" if he entered the case.
If he were allowed to represent his client before the court, Avenatti would have to stop his "publicity tour"-Wood said the term was not meant "in degradation", but as something he was able to do now, but which he wouldn't should he get to participate in the matter before her". He represents Daniels in a case concerning the actress' alleged 2006 affair with Trump and hush money that Cohen allegedly paid to silence her shortly before the 2016 election.
Avenatti told Business Insider that the attempt by Cohen's attorney's was "desperate".
The bad news for Michael Cohen just got worse today, as federal prosecutors are poised to receive more than one million files from three cellphones seized a month ago in a raid on Cohen's office. A total of eight boxes of documents, about a dozen cellphones, iPads and computers, and 19 hard drives and thumb drives were seized on April 9 when federal agents raided Mr. Cohen's office, apartment and hotel room.
U.S. District Judge Kimba Wood said a special taint team of prosecutors will make determinations after that date.
In an extensive Tuesday court filing, Michael Cohen's lawyers are trying to use a recent $10 million judgment against Michael Avenatti's law firm to prevent him from being admitted into Cohen's case, which is taking place in the Southern District of NY.
Avenatti denied doing something improper and complained about audio recordings of a dialog between Cohen and Daniels' prior lawyer Keith Davidson that had been leaked to the Wall Road Journal.
If Avenatti formally joined the court case, he would have to end his "publicity tour on TV and elsewhere" and stop asserting that Cohen is guilty of wrongdoing, actions that could "potentially deprive him of a fair trial", the judge told Avenatti.
Business Insider reported that Avenatti took aim at the Journal for a story on Monday that said he was hampering efforts by Southern District of NY federal prosecutors to obtain information from another of Daniels' attorneys, Keith Davidson.
Stephen Ryan, Cohen's lawyer, denied that charge Wednesday, acknowledging for the first time that there were "audio files" among the materials seized from Cohen, but telling Wood they were "under lock and key".
Avenatti says he also wants access to some seized records, possibly including recordings of phone calls, to see if they reveal confidential information about Daniels. Avenatti's involvement in the case so far, Ryan argued, has "turned (it) on it's head".
At a court hearing in Lower Manhattan, Wood sided with prosecutors in announcing a June 15 deadline for Cohen, President Trump's long-time fixer, to make all remaining claims of attorney-client privilege.
Judge Wood closed the hearing by reminding the court that the urgency to resolve the privilege issue quickly is rooted in the balance between concerns of attorney-client privilege and the need for the investigation to take its course.
